1. Acceptance of Terms

By accessing, downloading, installing, or using Creator App ("the Service," "we," "our," or "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

These Terms constitute a legally binding agreement between you and Creator App Studio. If you are using the Service on behalf of an organization, you represent and warrant that you have authority to bind that organization to these Terms.

By using the Service, you also confirm that you are at least 13 years old (or 16 in the European Union) and have the legal capacity to enter into this agreement.

2. Description of Service

Creator App is a mobile and web application platform designed to help creators build consistent posting habits for short-form content. Our Service includes:

  • Daily Recommendations: Personalized daily prompts and format references based on your niche and content preferences
  • AI-Powered Coaching: AI-generated insights, summaries, niche adaptations, and content suggestions based on successful video formats
  • Streak Tracking: Tools to track and maintain consistent posting habits across platforms
  • TikTok Integration: Connect your TikTok account to link your profile and receive personalized recommendations
  • Intervention Feature: (Premium feature) Screen time monitoring and intervention tools to help maintain focus and posting consistency
  • Analytics and Insights: Performance tracking and engagement metrics

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice.

3. User Accounts and Registration

3.1 Account Creation

To use certain features of the Service, you must create an account. You can register using:

  • Apple Sign-In
  • Google Sign-In

3.2 Account Security

  • You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account
  • You agree to notify us immediately of any unauthorized use of your account or any other breach of security
  • You are responsible for ensuring that any information you provide is accurate, current, and complete
  • We are not liable for any loss or damage arising from your failure to protect your account credentials

3.3 Account Restrictions

  • You may not create multiple accounts to circumvent usage limits or subscription restrictions
  • You may not share your account credentials with others
  • You may not transfer your account to another person without our prior written consent

4. Third-Party Platform Integrations

4.1 TikTok Integration

  • The Service allows you to connect your TikTok account through TikTok's OAuth API
  • By connecting your TikTok account, you authorize us to:
    • Access your TikTok account in accordance with TikTok's API permissions
    • Store TikTok OAuth access tokens and refresh tokens for the purpose of providing our services
  • Your use of TikTok's platform is governed by TikTok's Terms of Service and Privacy Policy. You agree to comply with TikTok's terms when using our TikTok integration features.
  • You may disconnect your TikTok account at any time through your account settings. Disconnecting will stop further data collection from TikTok.
  • We use TikTok OAuth tokens solely to provide our services and do not share your TikTok data with third parties except as necessary to operate our Service.

4.2 Other Third-Party Services

The Service may integrate with other third-party services. Your use of these services is subject to their respective terms and conditions. We are not responsible for the practices, policies, or content of third-party services.

5. Intellectual Property

5.1 Activity Data

  • Creator App does not enable users to create, upload, post, or share content within the Service
  • We may collect and process activity data related to your use of the Service, such as which recommendations you view, save, or interact with, and your posting history tracking
  • This activity data is used solely to provide and improve the Service, personalize your experience, and track your progress

5.2 TikTok Integration

  • When you connect your TikTok account, we store OAuth tokens to facilitate the integration between Creator App and TikTok
  • We use TikTok integration solely to provide our services and enable account linking functionality
  • You represent and warrant that you have the right to authorize us to access your TikTok account through OAuth
  • Your TikTok account and any content associated with it remains subject to TikTok's Terms of Service and intellectual property rights

5.3 Our Content and Intellectual Property

  • All content, features, functionality, design, and software of the Service are owned by Creator App Studio and are protected by copyright, trademark, and other intellectual property laws
  • You may not copy, modify, distribute, sell, or lease any part of our Service or included software, nor may you reverse engineer or attempt to extract the source code of that software
  • "Creator App" and related logos are trademarks of Creator App Studio

5.4 AI-Generated Content

  • The Service uses AI and machine learning to generate recommendations, summaries, coaching insights, and other content ("AI Content")
  • AI Content is provided for informational and educational purposes only and should not be considered professional advice
  • We do not guarantee the accuracy, completeness, or usefulness of AI Content
  • You use AI Content at your own risk and are responsible for verifying any information before relying on it

6. Subscriptions and Payment

6.1 Subscription Plans

  • Creator App offers subscription plans with different features and pricing (e.g., monthly and yearly plans)
  • Subscription fees are displayed in the app and may vary by region
  • We reserve the right to modify subscription plans, features, and pricing at any time, with changes taking effect at the start of your next billing cycle

6.2 Payment Processing

  • All payments are processed through Apple's in-app purchase system (for iOS) in accordance with Apple's Terms and Conditions
  • By purchasing a subscription, you agree to Apple's payment terms and authorize Apple to charge your payment method
  • We do not directly process or store payment card information
  • All subscription fees are charged in advance on a recurring basis (monthly or yearly, depending on your plan)

6.3 Subscription Renewal and Cancellation

  • Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period
  • You can cancel your subscription at any time through:
    • Your device's subscription settings (iOS Settings → Apple ID → Subscriptions)
    • The app's subscription management interface
  • Cancellation takes effect at the end of your current billing period. You will continue to have access to premium features until the period ends.
  • We do not provide refunds for partial subscription periods or unused portions of subscriptions, except as required by law

6.4 Free Trial

  • We may offer free trial periods for subscriptions
  • If you do not cancel before the trial ends, your subscription will automatically convert to a paid subscription
  • Trial terms, duration, and availability are subject to change

6.5 Price Changes

We reserve the right to change subscription prices. We will notify you of any price changes at least 30 days in advance. Price changes will apply to your next billing cycle after the notice period.

7. Intervention Feature (Premium)

7.1 Description

The intervention feature is a premium functionality that uses iOS's Family Controls framework to help you manage app usage time and maintain consistent posting habits.

7.2 How It Works

  • The feature monitors usage time of selected social media apps (such as TikTok) on your device
  • When usage thresholds are reached, the feature may display intervention screens or notifications to encourage content creation
  • The feature may temporarily restrict access to selected apps based on your settings and preferences

7.3 Requirements and Permissions

  • The intervention feature requires iOS 15.0 or later
  • You must grant Screen Time permissions through iOS Settings
  • You must select which apps to monitor and manage
  • You can enable or disable this feature at any time through your account settings

7.4 Limitations and Disclaimers

  • The intervention feature relies on iOS system capabilities and may be subject to iOS limitations and changes
  • We are not responsible for any issues or limitations arising from iOS system updates or changes to Family Controls
  • You use this feature at your own discretion and are responsible for managing your device settings
  • This feature is provided as-is and may not work perfectly in all scenarios or device configurations

8. Acceptable Use and Prohibited Conduct

You agree not to use the Service:

  • For any unlawful purpose or to solicit others to perform unlawful acts
  • To violate any international, federal, provincial, state, or local regulations, rules, laws, or ordinances
  • To infringe upon or violate our intellectual property rights or the intellectual property rights of others, including TikTok and other third-party platforms
  • To harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate based on race, gender, religion, ethnicity, or other protected characteristics
  • To submit false, misleading, or fraudulent information
  • To attempt to gain unauthorized access to any portion of the Service, other accounts, computer systems, or networks connected to the Service
  • To interfere with or disrupt the Service or servers or networks connected to the Service
  • To use automated systems (bots, scripts, scrapers) to access the Service without our express written permission
  • To reverse engineer, decompile, or disassemble any portion of the Service
  • To use the Service to violate TikTok's Terms of Service or any other third-party platform's terms
  • To collect or harvest any information from the Service using automated means
  • To impersonate any person or entity or falsely state or otherwise misrepresent your affiliation with a person or entity

9. Service Availability and Modifications

  • We strive to maintain high availability but do not guarantee uninterrupted, secure, or error-free service
  • The Service may be unavailable due to maintenance, updates, technical issues, or circumstances beyond our control
  • We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice
  • We are not liable for any loss or damage resulting from service interruptions or modifications
  • We may impose limits on usage, storage, or access to certain features

10. Termination

10.1 Termination by You

  • You may stop using the Service and delete your account at any time through the app settings
  • Cancelling your subscription does not automatically delete your account
  • If you delete your account, your access to the Service will terminate, and we will delete or anonymize your data in accordance with our Privacy Policy

10.2 Termination by Us

  • We reserve the right to suspend or terminate your account and access to the Service immediately, without prior notice, if:
    • You violate these Terms
    • You engage in fraudulent, abusive, or illegal activity
    • You fail to pay subscription fees when due
    • We are required to do so by law
    • Your use of the Service poses a security risk or is harmful to other users, us, or third parties
  • Upon termination, your right to use the Service will immediately cease
  • We are not obligated to provide refunds or compensation upon termination

10.3 Effect of Termination

  • Upon termination, all licenses and rights granted to you will immediately terminate
  • Sections of these Terms that by their nature should survive termination (including Sections 5, 11, 12, 13, 14, and 15) will survive

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT
  • WARRANTIES THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE
  • WARRANTIES THAT THE RESULTS OBTAINED FROM USING THE SERVICE WILL BE ACCURATE OR RELIABLE
  • WARRANTIES THAT ANY DEFECTS OR ERRORS IN THE SERVICE WILL BE CORRECTED

WE DO NOT WARRANT THAT THE SERVICE WILL MEET YOUR REQUIREMENTS OR THAT THE QUALITY OF ANY PRODUCTS, SERVICES, INFORMATION, OR OTHER MATERIAL OBTAINED BY YOU THROUGH THE SERVICE WILL MEET YOUR EXPECTATIONS.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU.

12. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, CREATOR APP STUDIO AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR:

  • ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
  • ANY LOSS OF PROFITS, REVENUES, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES
  • DAMAGES RESULTING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE
  • DAMAGES RESULTING FROM UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA
  • DAMAGES RESULTING FROM STATEMENTS OR CONDUCT OF ANY THIRD PARTY ON THE SERVICE
  • DAMAGES RESULTING FROM ACTIONS OF THIRD-PARTY SERVICES, INCLUDING TIKTOK, APPLE, OR GOOGLE

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRIOR TO THE EVENT GIVING RISE TO THE LIABILITY, OR ONE HUNDRED DOLLARS ($100) IF YOU HAVE NOT PAID ANY AMOUNTS, WHICHEVER IS GREATER.

SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

13. Indemnification

You agree to defend, indemnify, and hold harmless Creator App Studio and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses, including without limitation reasonable attorney's fees and costs, arising out of or in any way connected with:

  • Your access to or use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights, including TikTok's Terms of Service
  • Any content from your connected third-party accounts (such as TikTok) that you authorize us to access
  • Any other party's access and use of the Service with your account credentials

14. Dispute Resolution

14.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of Delaware, United States, without regard to its conflict of law provisions.

14.2 Dispute Resolution Process

Before filing a claim, you agree to try to resolve the dispute informally by contacting us at support@creatorappstudio.com. We will try to resolve the dispute informally within 30 days.

14.3 Binding Arbitration

If we cannot resolve a dispute informally, you and Creator App Studio agree to resolve any claims relating to these Terms or the Service through final and binding arbitration, except as set forth below. The arbitration will be conducted under the rules of American Arbitration Association (AAA).

14.4 Exceptions

You may opt out of arbitration and bring claims in small claims court in Brooklyn, New York, or you may bring claims for injunctive or equitable relief in any court of competent jurisdiction.

14.5 Class Action Waiver

You agree that you will only resolve disputes with us on an individual basis and will not bring a claim as a plaintiff or a class member in a class, consolidated, or representative action.

15. General Provisions

15.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Creator App Studio regarding the Service and supersede all prior agreements and understandings.

15.2 Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

15.3 Assignment

You may not assign or transfer these Terms or your account without our prior written consent. We may assign or transfer these Terms or our rights and obligations without restriction.

15.4 Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

15.5 Force Majeure

We shall not be liable for any failure to perform our obligations under these Terms where such failure results from circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, labor disputes, or changes in third-party services or APIs.

15.6 Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of any material changes by:

  • Posting the new Terms on this page
  • Updating the "Last updated" date
  • Sending you an email or in-app notification (for significant changes)

Your continued use of the Service after such modifications constitutes acceptance of the updated Terms. If you do not agree to the modified Terms, you must stop using the Service and may delete your account.
